Yes, you read that correctly, there really is! This ‘Zone of Death’ was discovered in 2005!
Even now you can still get away with murder in the Zone of Death. For some reason, nothing has been done about this terrible area, so you should definitely steer clear. This comes from information in a 14-page article known as “The Perfect Crime” it was written by a professor Brian Kalt from the Michigan State University. In this article, he talks about a judicial no-man’s land in the Idaho part of Yellowstone in which a person could commit a crime and get away with it because of sloppy jurisdiction boundaries in the area.
He was researching this topic in 2004 and as he began researching he just could not stop, as he dug deeper he uncovered more and more information. He researched obscure jurisdictional gray areas when he found a reference to the unusual jurisdiction of Yellowstone National park, Yellowstone like all other national parks are federal land, portions of it fall in three different states. Those states are Idaho, Montana, and Wyoming. With that being said, Congress placed the entire park in Wyoming’s federal district. That meaning Wyoming’s federal district is the only one able to cross state lines.
To the constitutional lawyer like Kalt, this was a huge red flag. He knew that Article III of the Constitution requires federal criminals to be held in the state that the crime was committed.The sixth amendment entitles a federal criminal defendant to a trial by jurors living in the state and district where the crime took place but if the crime itself took place in an uninhabited portion of Idaho, it would be impossible to form a jury. Also, with it being federal land, the state itself would have no jurisdiction either.
This location he had uncovered seemed to be the perfect spot for the perfect crime without a doubt. Kalt’s paper was published in the Georgetown Law Journal and he even sent copies of it to the Department of Justice, US attorney in Wyoming, and the House and Senate in hopes of getting something done about this area as he thought his article could possibly inspire someone to do something terrible. He wrote that it would be a very simple fix, all that would need to be done would be for Congress to divide Yellowstone into three federal districts. He even drafted the legislation change himself but the response he got was that no one intended to do anything about this issue.
